- Can I list the house before I receive Letters Testamentary?You can prepare and even market a probate home early, but you cannot sign a binding listing or accept an offer until the court issues Letters.
- Can I accept an offer before the court appoints me?No. Only the appointed personal representative can accept an offer for the estate, and even then it may be subject to court confirmation.
- Who signs the listing agreement?The appointed personal representative signs the listing agreement as seller, not the heirs or beneficiaries.
- Can the executor live in the home?An executor may occupy the home in some cases, but it raises fair-rent and fiduciary-duty issues that must be handled carefully.
- Can I sell the home as-is?Yes. Probate homes are commonly sold as-is, and the estate is exempt from the standard Transfer Disclosure Statement.
- Do I have to make repairs before selling?No. Estates are not required to make repairs. Many probate homes sell as-is, though targeted fixes sometimes raise the net proceeds.
- Should I renovate before selling?Usually not extensively. Estates rarely benefit from major renovations, though light, high-return improvements can be worth it.
- What if the house is full of belongings?A full house is normal in probate. You can inventory, distribute keepsakes, then clear the rest through an estate sale or clean-out.
- Who pays for the clean-out?Clean-out costs are typically paid by the estate as an administration expense, often from sale proceeds at closing.
- Can I sell with tenants still living there?Yes, but existing leases and California tenant protections carry over to the sale and affect buyer pool and price.
- Can I sell if there is a reverse mortgage?Yes. A reverse mortgage becomes due at the owner’s death and is paid off from the sale proceeds like any other loan balance.
- Can I sell if the home is in foreclosure?Often yes. A probate home can usually be sold ahead of the foreclosure sale date to protect the estate’s equity, but you must act fast.
- Can I sell a probate home to a cash buyer or investor?Yes. Cash buyers can close fast and buy as-is, but weigh their discount against listing on the open market for the best price.
- How is the list price set in a probate sale?Pricing blends the probate referee’s appraisal with current market comparables. In confirmation sales, the 90 percent floor also applies.
