Can the Executor Live in the Probate Home?
Sometimes, but it has to be handled carefully. An executor or administrator has a fiduciary duty to act in the best interest of all the beneficiaries, not to obtain a personal benefit from estate property. Living in the home rent-free while the estate carries the costs can be challenged by other heirs as a breach of that duty.
If an executor does occupy the property, the clean approach is to pay fair market rent to the estate and to keep the beneficiaries informed. Where the home needs to be sold to pay debts or to divide value among heirs, occupancy that delays the sale is likely to draw objections. When in doubt, get the beneficiaries' written consent or the court's guidance.
