What Happens to Unpaid HOA Dues in Probate?


Homeowners association dues keep accruing after death, and unpaid dues become a debt tied to the property. An HOA can record a lien and, in extreme cases, pursue collection, so it is best not to let them pile up. For a home headed to sale, the outstanding balance is normally paid off at closing from the proceeds, clearing the lien so title can transfer.

While the home is on the market, keeping dues current where possible avoids penalties and keeps the association cooperative, which matters because HOAs must provide disclosure documents buyers need. If cash is tight, plan for the arrears to be settled from proceeds. We coordinate with escrow and the HOA to make sure nothing surprises the closing.
