Who Pays Closing Costs in a Probate Sale?
The estate pays the standard seller-side closing costs, and like the commission they are netted out of the sale proceeds at closing rather than paid separately by the heirs. Typical seller costs include title and escrow fees, county transfer taxes, any prorated property taxes, and payoff of existing loans or liens.
Because everything settles from proceeds, an estate with equity generally does not need cash on hand to close. Buyers pay their own closing costs, and in probate the split of costs follows local custom unless negotiated. We provide a clear net-proceeds estimate before you accept an offer so the representative and heirs know exactly what the estate will receive.
