Can You Transfer Bank Accounts Without Probate?
Frequently yes. Bank accounts often pass without probate. If the account had a payable-on-death beneficiary or a surviving joint owner, the funds transfer directly to that person on presenting a death certificate and identification, with no court involvement.
If there was no beneficiary or joint owner but the total estate is under the small-estate threshold, a successor can usually claim the account with a small estate affidavit after the required waiting period. Full probate is generally needed only when accounts lack these features and the estate exceeds the limit. Because a home in the decedent's name often pushes an estate over the threshold, families sometimes still open probate for the house while collecting accounts separately.
