What Happens If the Winning Bidder Backs Out?


Because confirmation-sale buyers put up a significant deposit and remove their contingencies, backing out is costly for them. A buyer who defaults after the court confirms the sale can forfeit that deposit, and the estate has remedies. The representative can return to the property to a backup bidder, reset the sale, or in some cases pursue the defaulting buyer for the estate's losses on a resale.

This structure is deliberate. It discourages non-serious bidding and protects the estate. In practice, well-qualified buyers rarely walk once a sale is confirmed. We vet buyers carefully and keep a backup offer in position where possible so a rare default does not derail the estate's plans.
