California Probate Timeline: Step by Step

A California probate follows a predictable sequence, even though the total time varies. Understanding the stages helps you see where the home sale fits.

The main stages

• File the petition for probate and get a hearing date, often several weeks out.
• Give notice to heirs and creditors and publish notice as required.
• Appointment hearing, where the court names the representative and issues Letters.
• Inventory and appraisal by the probate referee.
• Creditor claim period and payment of valid debts and taxes.
• Sell the home, either under full authority or through court confirmation.
• Final accounting, petition for distribution, and closing the estate.

Most estates run about nine to eighteen months. The home can usually be listed once Letters issue, well before the case closes, which is why the sale itself does not have to wait for the final stages.
