What Is the First Step After Someone Passes Away?


Before anything legal happens, the practical priorities are to secure the property and gather documents. Make sure the home is locked and insured, collect the original will if there is one, and order several certified copies of the death certificate, which you will need for nearly every step that follows.

Then confirm how the estate will be handled

Look at how the home is titled and whether a living trust exists. If there is a trust, the successor trustee steps in and probate is often unnecessary. If the home was owned in the decedent's name alone, the next step is opening a probate case with the San Diego Superior Court so a personal representative can be appointed.

A sensible early checklist

  • Secure the house, change or verify locks, keep insurance active.
  • Find the original will and any trust documents.
  • Order five to ten certified death certificates.
  • Make a short list of assets and any mortgages or liens.
  • Speak with a probate attorney and a probate-experienced agent early.
