Can Beneficiaries Stop a Probate Home Sale?

Beneficiaries have real tools, but stopping a sale entirely is difficult when the representative is acting properly. On receiving a Notice of Proposed Action, a beneficiary can deliver a written objection, which pushes the sale into court supervision. A beneficiary can also ask the court for an order restraining the representative from acting without court oversight, and the court can grant that request.

What these tools do is add a layer of judicial review, not automatically cancel the sale. If the court finds the sale is fair and in the estate's interest, it will typically allow it to proceed under confirmation. Genuine grounds, like an unfairly low price or self-dealing, carry much more weight than simple reluctance to sell.
